Terraform Labs and Do Kwon Held Liable for $40B Crypto Catastrophe

Apr 08, 2024 at 07:04 pm

In a New York court, a jury has found Terraform Labs (TFL) and its founder, Do Kwon, liable for misleading investors in the $40 billion LUNA and UST crypto debacle. The ruling centers on allegations that TFL misrepresented the stability of UST, leading to its collapse and substantial investor losses. While TFL disputes the verdict, claiming the SEC has no authority over the company, the court will determine appropriate penalties and compensation.

Jury Holds Terraform Labs and Do Kwon Accountable for $40 Billion Crypto Catastrophe

New York, United States - In a landmark verdict, a jury in New York has found Do Kwon and his company, Terraform Labs (TFL), liable for defrauding investors in the $40 billion crypto disaster involving the LUNA and UST cryptocurrencies.

The ruling is a resounding victory for the Securities and Exchange Commission (SEC), which brought the case against Kwon and TFL, alleging that they misled American investors about the stability of TerraUSD (UST), an algorithmic stablecoin issued by the company. The SEC contended that Kwon and TFL knowingly made false and misleading statements about UST, which ultimately led to its collapse in mid-2022, eroding billions of dollars in investor funds.

During the two-week trial in Manhattan, prosecutors presented a compelling case against Kwon and TFL, calling upon investors who had lost their entire savings as a result of the Terraform Labs scheme. Whistleblowers with connections to TFL also testified, revealing that Kwon was fully aware of the misleading nature of his statements to investors.

The prosecution presented evidence of other fraudulent acts by Kwon, including lying about the use of Terra's blockchain by Chai, a popular payments platform in South Korea. Additionally, Kwon was shown to have made a secret deal with Jump Trading, a high-frequency trading firm, to artificially prop up the value of UST when it fell below $1.

In her closing arguments, SEC attorney Laura Meehan emphasized the deliberate deception employed by Kwon and TFL: "If you swing big and you miss, and you don't tell people that you came up short, that is fraud."

Terraform Labs Condemns Ruling

Immediately after the jury's verdict, TFL issued a statement expressing its disappointment and pledging to appeal the ruling. The company claimed that the case was built on statements taken out of context and that it had always been truthful about its products. TFL lawyer Louis Pellegrino noted that the company was still working on its mission despite the recent setbacks.

Consequences and Ongoing Legal Battles

Although the jury found Kwon and TFL liable, Kwon will not face prison time as the case was civil in nature. However, the court will determine appropriate fines and disgorgement, which could involve forcing the defendants to return ill-gotten gains.

Currently, Kwon remains in Montenegro, where he was arrested and jailed last year. While he has completed his prison sentence, an extradition battle between the United States and his native South Korea is ongoing. Should he be extradited to the US, Kwon would face criminal fraud charges in the same court where he was found liable for civil charges.

The verdict against Kwon and TFL serves as a significant milestone in the ongoing regulatory scrutiny of the crypto industry. It sends a clear message that those responsible for defrauding investors will be held accountable, regardless of the novel and complex nature of their schemes.
