According to its Form 8-K filing to the US Securities and Exchange Commission (SEC) and Saylor’s recent post, Strategy executed a total of 7,390 BTC purchase between May 12 and 18. The acquisition amounted to around $764.9 million at an average of $103,498 per BTC.

The firm sourced the funds from the sale of $705.7 million worth of shares under its Class A Common Stock (MSTR Shares) and another $59.7 million worth of shares under series A perpetual strike preferred stock (STRK Shares). As of May 18, there are still $39.77 billion MSTR and STRK shares left, which Strategy will likely use to finance more Bitcoin purchases in the future and for other corporate purposes.

As a result of its new batch acquisition, Strategy has grown its BTC yield to 16.3% year-to-date (YTD). At Bitcoin’s values between a $102,112.69 low and a $107,068.72 high in the last 24 hours, the company reflected an unrealized gain of around $18.66 billion to $21.52 billion.

Strategy also provided an update in its SEC filing about the class action lawsuit it’s facing under the jurisdiction of the US District Court for the Eastern District of Virginia. The case named Saylor, Phong Le (Strategy’s CEO and President), and Andrew Kang (Strategy’s Executive Vice President) as defendants. The complainants alleged that the parties made false and/or misleading information regarding the profitability of the company’s bitcoin-focused investment strategy and treasury operations. In addition, they accused the Strategy officials of withholding information relating to the issue as well as matters pertaining to BTC’s volatility.

The class suit sought unspecified damages, legal costs, and other reliefs from the defendants. However, Strategy claimed it would do everything in its power to defend itself and its executives against the charges.

Strategy admitted that it’s hard to predict the result of the litigation. Moreover, it pointed out that it couldn’t provide a reasonable estimate at the moment of the possible losses it may incur during the pendency and resolution of the case.
