Judge Analisa Torres, who issued a ruling on the XRP case last year, differentiated between primary transactions (buyers purchasing XRP directly from Ripple) and secondary transactions (anonymous exchanges on exchanges), considering the latter not to constitute security transactions. However, Torres has yet to address the SEC's accusation that Ripple sold XRP as a security token in primary market transactions.

In contrast, Judge Jed Rakoff and Judge Katherine Polk Failla, who presided over separate cases involving Terra/Luna and Coinbase, respectively, took a broader view, suggesting that aggressive marketing strategies by crypto companies could influence both primary and secondary market transactions, potentially classifying even exchange-based crypto transactions as unregistered security sales.

Maitra emphasizes the regulatory uncertainty surrounding crypto markets in the US, as there is no specific legal framework governing them. This lack of clarity has led to divergent judicial opinions, highlighting the evolving nature of cryptocurrency regulation.

"It is inevitable that this [the Ripple vs SEC case] will end up in the second circuit and maybe even beyond," Maitra said, likening it to the ongoing Coinbase case. "There is still much to be done in this particular decision."

SEC's Determination and Ripple's Rebuttal

Despite the setback in the XRP case, the SEC is reportedly not viewing it as a failure of its theory regarding secondary trading of cryptocurrencies. Instead, it is seen as a temporary setback due to insufficient evidence.

Ripple CEO Brad Garlinghouse has staunchly denied the SEC's allegations, arguing that XRP is not a security. He emphasized its utility as a facilitator of cross-border payments, contrasting it with traditional securities.
