The SEC's arguments in support of its motion for remedies against Ripple have been criticized by Ripple's legal team as weak and failing to apply the law faithfully. The SEC's request for injunctions based on assumptions of future violations has been met with skepticism, particularly in light of the potential dismissal of a similar lawsuit against Binance and the DOJ's filing in the Mango Markets case, which contradicts the SEC's position on stablecoins as unregistered securities.

The highly anticipated reply from the United States Securities and Exchange Commission (SEC) in support of its motion for remedies and final judgment has been met with criticism by Ripple Labs Inc. and its Chief Legal Officer, Stuart Alderoty.

In a statement, Alderoty denounced the SEC's arguments as "More of the same from the SEC — failing to faithfully apply the law and trying to pull the wool over the Judge's eyes." He expressed confidence that the court would approach the remedies phase of the lawsuit fairly and suggested that it could be nearing its conclusion.

SEC Attacks Ripple's Stablecoin Plan

Notably, the SEC's reply included a request for injunctions based on assumptions of future violations by Ripple. This request was accompanied by an attack on Ripple's proposed stablecoin plans, with the securities regulator arguing that an injunction was necessary to prevent such issuance.

XRP expert Ashley Prosper has indicated that a ruling on a motion to dismiss filed by the cryptocurrency exchange Binance could be imminent. Prosper believes that Judge Analisa Torres is likely to rule that Binance's BUSD stablecoin is not a security.

Binance Lawsuit Ruling May Benefit Ripple

In a significant development, Binance has argued that a recent filing by the United States Department of Justice (DOJ) in the Mango Markets lawsuit contradicts the SEC's position that BUSD and other stablecoins are unregistered securities. This filing, as exclusively reported by CoinGape, may bolster Ripple's case against the SEC's claims that its own XRP token and On-Demand Liquidity (ODL) sales constitute unregistered securities.

Ripple Anticipates Expert Witness and Remedies Decisions

As the lawsuit progresses, Ripple is awaiting decisions on its request for expert witness testimony and the remedies sought by the SEC. The company remains confident in its defense and believes that the court will ultimately recognize the merits of its case.
