In a response to a court order, the U.S. Securities and Exchange Commission (SEC) has clarified its stance regarding Coinbase's petition for rulemaking and its recent enforcement action against the cryptocurrency trading platform. The SEC emphasized that it has not yet made a decision on the petition and that its enforcement action is not contingent upon a decision on rulemaking.

Coinbase had argued that the SEC's enforcement action indicated a rejection of their petition, which sought to establish clear regulations for cryptocurrency trading. However, the SEC insists that no decision has been made, and its staff anticipates making a recommendation within the next 120 days.

The SEC emphasized that Coinbase remains subject to existing laws regardless of the outcome of the rulemaking process. "Coinbase – like everyone else – is bound by existing law," the SEC filing stated. "And Coinbase is free to vigorously assert its position that it has not violated that law in the current enforcement action."

Coinbase Chief Legal Officer Paul Grewal expressed skepticism towards the SEC's response, tweeting that the agency is "ignor[ing] the clear statements of the Chair that confirm they have no intent to issue new rules." Grewal argued that the SEC is conflating the absence of new rules with a denial of the rulemaking petition.

The SEC counters that statements made by individual commissioners do not constitute official Commission action and that a majority vote of a quorum is required for any decision on rulemaking.

The SEC's response underscores the ongoing uncertainty surrounding the regulatory landscape for cryptocurrency trading in the United States. Coinbase maintains its belief that the SEC has effectively rejected their petition, while the SEC insists that it has not made a decision and that Coinbase remains subject to existing laws.

The outcome of the rulemaking petition could have significant implications for the cryptocurrency industry, potentially providing clarity on the legal status of digital assets and the regulatory framework for trading platforms. However, until a decision is reached, the uncertainty surrounding cryptocurrency regulation is likely to persist.
