2023년 디지털 개인 데이터 보호법(DPDP): 정부가 2025년 DPDP 규칙 초안 통지

부바네스와르: 디지털 개인 데이터 보호법(DPDP) 2023이 통과됨에 따라 전자정보기술부(MEIT)는 금요일 디지털 개인 데이터 보호 규칙 2025 초안을 통지했습니다.

The Ministry of Electronics and Information Technology (MEIT) has notified the Draft Digital Personal Data Protection (DPDP) Rules 2025 in pursuance to the passing of the DPDP Act 2023.

전자정보기술부(MEIT)는 DPDP법 2023의 통과에 따라 디지털 개인정보 보호(DPDP) 규칙 2025 초안을 공지했습니다.

As per the draft DPDP rules, social media intermediaries, like Google, Whastapp, Facebook, instagram and X, cannot open account of any minor, who is less than 18-years of age, without the consent of their parents.

DPDP 규칙 초안에 따르면 Google, Whastapp, Facebook, Instagram, X와 같은 소셜 미디어 중개자는 부모의 동의 없이 18세 미만의 미성년자의 계정을 개설할 수 없습니다.

Moreover, they have to delete the personal data of all users after three years.As per Rule 10 of the draft DPDP, a Data Fiduciary shall adopt appropriate technical and organisational measures to ensure that verifiable consent of the parent is obtained before the processing of any personal data of a child.

또한 3년 후에는 모든 사용자의 개인 데이터를 삭제해야 합니다. DPDP 초안 규칙 10에 따라 데이터 수탁자는 모든 데이터를 처리하기 전에 부모의 검증 가능한 동의를 얻을 수 있도록 적절한 기술 및 조직적 조치를 채택해야 합니다. 아동의 개인 데이터.

It further said, they have to observe due diligence by checking that the minor’s parents are present physically at the time of opening the account and that they are fully aware of the implications of opening the account for the minor.

또한 계좌 개설 시 미성년자의 부모가 실제로 함께 있는지, 미성년자 계좌 개설이 미치는 영향을 충분히 인지하고 있는지 확인하여 실사를 준수해야 한다고 밝혔습니다.

The Data Fiduciary shall also maintain a record of the consent obtained from the parents for a period of not less than three years from the date of obtaining such consent and shall produce the same before the Central Government or any authority authorised by it, on demand.

또한 데이터 수탁자는 동의를 얻은 날로부터 최소 3년 동안 부모로부터 얻은 동의 기록을 유지해야 하며, 요청 시 중앙 정부 또는 중앙 정부가 권한을 부여한 당국에 이를 제출해야 합니다.

The draft DPDP Rules 2025 in its third schedule, has clearly outlined who are social media intermediaries in India and has set a timeline to store personal data.
