Patrick Hansen, who is in charge of Strategy and Policy for the EU region at Circle, said that the EU wants to make MEV "illegal" when talking about the plan.

ESMA's implementation guidelines for various rules in MiCA (Markets in Crypto Assets Regulation) include the MEV restriction (Markets in Crypto Assets Regulation).

For those who don't know, MEV is a way for miners and validators to make more money by changing the order of transactions to give priority to those that pay more.

In ESMA's plan (page 10), the "re-ordering" part of MEV is seen as "market abuse."

“Second, ESMA notes that where MiCA specifies that orders, transactions, or other aspects of the distributed ledger technology may suggest the existence of market abuse, e.g., the well-known Maximum Extractable Value (MEV), whereby a miner/validator can take advantage of its ability to arbitrarily reorder transactions to front-run a specific transaction(s) and therefore make a profit.”

Before the end of June, stakeholders are asked to give their thoughts on the draft standards. Brokers and cryptocurrency exchanges will be required to notify authorities of any suspicious transactions or re-orders if the standards are implemented.

However, Hansen highlighted the difficulty in putting the plan into action if it is approved, pointing out that each instance of MEV must be reported and that MEV operators may face indictments and charges.

The EU's actions appear to follow those of the US. Two brothers were recently charged by the US DoJ for exploiting a complex MEV technique on the Ethereum network to the tune of $25 million.

It was the first time that charges had been brought in a scenario involving MEV. However, with the EU's plan, it appears that more operators could face charges.

Robert Sasu of MultiversX, for his part, stated that "MEV" was theft and expressed support for the EU's plan.

However, the EU's proposal came under fire from the cryptocurrency analytics platform Coinalyze, which stated,
