Ripple vs. SEC: What Is Form C, and What Does It Mean for XRP?

Oct 20, 2024 at 11:01 pm

The long-standing legal battle between Ripple Labs and the U.S. Securities and Exchange Commission (SEC) has taken an intriguing turn. Ripple's announcement of an upcoming submission of Form C has ignited speculation that the lawsuit might be approaching its conclusion.

Ripple vs. SEC: What Is Form C, and What Does It Mean for XRP?

Investors in XRP are left wondering why the token’s price isn’t surging following a string of positive developments in Ripple’s lawsuit with the U.S. Securities and Exchange Commission (SEC).

As previously reported, Ripple is set to submit Form C, a document typically used for exemptions in securities offerings, to the SEC. This move could help showcase Ripple’s compliance and transparency, potentially weakening the SEC’s argument that XRP is a security.

However, despite a court ruling that XRP sales through exchanges to retail investors were not securities transactions, and the SEC’s partial concession in not appealing this ruling, XRP’s price has remained stagnant.

One reason for this could be the overall lack of strong buying pressure on XRP. As highlighted by a flattening On-Balance-Volume (OBV) indicator, October’s trading has seen minimal net inflows into the market.

Additionally, the Chaikin Money Flow (CMF) indicator continues to show selling pressure, suggesting that major market participants are still hesitant to fully commit to buying XRP.

Another factor that may be contributing to XRP’s lackluster price performance is market sentiment. Following a surge in institutional interest during 2021, investors may be exercising caution after witnessing the rapid rise and fall of crypto prices.

Moreover, other large-cap altcoins, such as Polygon (MATIC) and Chainlink (LINK), have captured traders’ attention with more immediate growth prospects. This shift in focus could mean that XRP isn’t the top pick for those traders seeking quick returns.
