Industry Fights Back on Final “Broker” Rule from IRS

Starting in 2027, cryptocurrency brokers will be required to disclose the gross proceeds from any crypto sales to their customers. They must also provide details about the taxpayers involved in the transactions.

This week, the DeFi Education Fund filed a lawsuit against the Treasury Department and the Internal Revenue Service (IRS) over the new rules. The group claims that the regulations are an overreach and could effectively serve as a ban on decentralized finance (DeFi).

Industry Groups File Lawsuit Against IRS Over Crypto ‘Broker’ Rule

Joined by the Blockchain Association and the Texas Blockchain Council, the group argues that the rules go beyond the agencies’ legal authority, violating the Administrative Procedure Act (APA) and the U.S. Constitution.

At the heart of the issue is how the IRS defines “brokers” under the finalized rules. Front-end providers, such as those building interfaces for decentralized applications (dApps), could be classified as brokers. Even developers of unhosted wallet applications might fall under this category.

Critics argue that this stretches the common-sense understanding of the term far beyond its historical meaning. The broad definition could stifle innovation and force developers to shut down their operations.

They also warn that it could threaten U.S. competitiveness in blockchain technology.

As the court battle unfolds, crypto advocates are urging Congress to intervene using the Congressional Review Act (CRA). This law allows Congress to overturn federal agency rules by passing a resolution with a simple majority in both houses. The resolution also requires the President’s approval.

Crypto Advocates Call for Congressional Action on IRS Rule

The Blockchain Association and other groups believe that the new rule could set a dangerous precedent for overregulation. They’re calling on crypto enthusiasts, developers, and everyday users to contact their members of Congress.
