The Competition Commission of Pakistan (CCP) has recently issued an order regarding the use of tokens in paint advertising, following a complaint filed by Nippon Paints against Diamond Paints. The order highlights the importance of proper disclosure of tokens, considering their impact on customer purchasing decisions. Diamond Paints' defense argued that the complaint failed to specify how the TVC misled consumers and that paint manufacturers should not be obligated to include disclosures about industry-wide practices in their limited advertising time or space.

Despite the arguments, the CCP ruled in favor of Nippon Paints, emphasizing the critical nature of token disclosures for customers. Master Paints was fined Rs 50 lakhs for violating Section 10 of the Competition Act, 2010, by engaging in deceptive marketing practices.

The order's implications extend beyond Diamond Paints, potentially affecting all paint advertisements. Companies like Master Paints could now identify TVCs without proper disclosures and report them to the CCP, leading to fines and negative publicity for their competitors. Even Nippon Paints, which initiated the complaint, acknowledges that they may need to adjust their marketing strategy.

A Nippon Paints representative highlighted that the company has always disclosed tokens in its campaigns and products, considering customers' right to know. They expressed hope that other brands would follow suit, especially in broader advertising channels, to enhance customer understanding and informed decision-making.

The CCP's order ultimately complicates matters for paint manufacturers, and it remains to be seen whether the industry will collectively agree to ignore the decision or take it more seriously, impacting advertising strategies and consumer choices in the paint market.
