Bitcoin and Ethereum Officially Commodities, Says CFTC

Jul 11, 2024 at 05:28 pm

Significant statements on cryptocurrencies were made by CFTC Chairman Rostin Behnam during a recent Senate Committee hearing.

Bitcoin and Ethereum Officially Commodities, Says CFTC

Commodity Futures Trading Commission (CFTC) Chairman Rostin Behnam stated during a Senate hearing on Thursday that Bitcoin and Ethereum are classified as commodities and not securities, aligning with a recent court decision and disputing the stance taken by the Securities and Exchange Commission (SEC) on the majority of cryptocurrencies.

Bitcoin, Ethereum Officially Commodities: CFTC

Several crucial statements regarding cryptocurrencies were made by CFTC Chairman Rostin Behnam during a recent hearing held by the Senate Committee on Agriculture, Nutrition, and Forestry.

He reiterated that Bitcoin and Ethereum are classified as commodities under the Commodities Exchange Act. Their classification follows a recent decision made by a district court in Illinois, which affirmed their status.

As reported by Fox Business journalist Eleanor Terrett, CFTC Chairman Behnam stated that Bitcoin and Ethereum are recognized as digital commodities under the Commodity Exchange Act, according to Coinpedia. Here’s what she posted on her X handle:

For regulatory purposes, it is important to distinguish commodities from securities, where commodities are tradable products like oil or gold, while securities represent a share of ownership in a company. This classification puts Bitcoin and Ethereum under the jurisdiction of the CFTC, which is separate from assets overseen by the SEC.

70%-80% of Cryptocurrencies Not Securities: Behnam

Coingape shares that Behnam disputed SEC Chairman Gary Gensler’s view, stating that 70%-80% of cryptocurrencies are not securities, highlighting the ongoing debate on how digital assets should be regulated.

This distinction may bring clarity as Bitcoin and Ethereum are now accepted as commodities. It could set the stage for wider acceptance in the crypto market. The precedent may also reduce some of the uncertainty that has hindered growth in the market.

Future CFTC Legislation For Non-Security Token Oversight

Moving forward, Behnam wants legislation to ensure the CFTC has oversight of non-security tokens, highlighting the need for strong investor protections due to the market’s volatility. His comments show a willingness to balance oversight with encouraging further development in the crypto space.

The world of Defi is currently experiencing rapid technological and regulatory developments. At the heart of understanding how the regulations are changing is the distinction between commodities and securities. Behnam’s comments highlight the CFTC’s efforts to adapt regulations to keep up with the dynamic nature of the digital frontier.
